Liability Waiver and Release

Read this carefully. It affects legal rights. This waiver is signed by the parent or legal guardian of the registered player (“Participant”), on their own behalf and on behalf of the Participant, or by the Participant if 18 or older.
1. Risks of baseball
I understand that baseball and combine activities, including sprinting, throwing, pitching, hitting, fielding and live at-bats, carry risks of injury, some serious, including being struck by a pitched, batted or thrown ball or bat, collisions, falls, sprains, fractures, overuse injuries, concussions and, rarely, permanent disability or death. I understand the facility and other people present also create risks.
2. Assumption of risk
I voluntarily choose to have the Participant take part, and I knowingly accept all of these risks, known and unknown.
3. Release
To the fullest extent the law allows, I release and agree not to sue Cold Weather Bats, its owners, staff, volunteers, sponsors and partners, Barwis Physical Therapy, and 2SP and its owners and staff (together, the “Released Parties”) for any injury, illness, loss or damage connected with the combine, including claims based on the ordinary negligence of a Released Party. This release does not cover gross negligence or willful misconduct.
4. Indemnity
To the extent the law allows, I agree to cover the Released Parties for any claim, cost or legal fee arising from the Participant’s participation or conduct.
5. Rules and equipment
The Participant will follow staff instructions and facility rules and will wear a batting helmet when hitting and a catcher’s helmet and gear when catching. CWB may remove any Participant who is unsafe or disruptive, without refund.
6. Refunds and changes
Spots are capped. A registration cancelled at least one week before the event is refunded. A registration cancelled with less than one week of notice, or a no-show, is not refunded. Event times and activities may change because of weather, facility needs or other reasons. If CWB cancels the event, registrations will be refunded.
7. General
This waiver is governed by Michigan law. If any part is found unenforceable, the rest still applies. I have read this waiver, understand it, and agree to it by checking the box on the registration form.
